The Anti Counterfeiting Action Group, Inc. (ACAG) is an incorporated association (A0039387M) of manufacturers, wholesalers and traders of goods who are concerned with the sale of counterfeit products throughout Australia and New Zealand.

In Australia, it is an offence to use a registered trade mark without the authorisation of the registered owner or authorised user. It is also an offence to use any copyright owned by others, without their authorisation. The penalties imposed under the Trade Marks Act 1995 and the Copyright Act 1968 allow for penalties up to $50,000 fine and/or 2 years imprisonment.

In New Zealand Section 124 of the Trade Marks Act 2002, creates offences for the importation to New Zealand, selling or exposing for sale or possessing goods to which a registered trade mark has been falsely applied. Section 125 makes provision for fines of up to $150,000 and/or a term of imprisonment not exceeding 5 years. Orders for delivery up may also be obtained.
